FolioProjects.com – Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FolioProjects.com platform, services, content, features, and applications (collectively, the "Platform") operated by Beyond Programs Ltd ("we", "us", or "our"). By accessing or using the Platform, you agree to be bound by these Terms.

1. Use of Platform

You must be at least 18 years old or have the permission of a legal guardian to use this Platform. You agree to use the Platform in compliance with all applicable laws and regulations.

You may not:

  • Use the Platform for illegal or unauthorized purposes

  • Attempt to hack, disrupt, or compromise Platform integrity

  • Post or share false, misleading, or defamatory content

2. Account Registration

To access certain features, you must create a user account. You agree to provide accurate and complete information and to update it as necessary. You are responsible for maintaining the security of your account and all activities that occur under it.

3. Content Ownership and Licenses

You retain ownership of content you upload or create on the Platform. However, by posting content, you grant us a non-exclusive, royalty-free license to use, display, and distribute that content for purposes of operating and promoting the Platform.

You may not post content that infringes on intellectual property rights, privacy rights, or other legal protections.

4. Project & Portfolio Visibility

By default, projects and portfolios are viewable to the public. You may set certain projects or assets to private. Public content may be indexed by search engines or featured in promotional materials.

5. Ad Revenue Sharing Program

Once your profile surpasses 1,000 followers on FolioProjects.com, you become eligible to opt into our Ad Revenue Sharing Program.

Eligible users may earn a share of ad revenue generated from:

  • Ads shown on their FolioProjects profile, asset pages, or public-facing content

  • Ads displayed between status updates on smart screens (e.g., in offices, events, or public venues)

Additionally, you may monetize your content by embedding your project QR code into videos, print, digital media, or physical locations. When a verified user scans your QR code, advertisers are charged, and you receive a portion of that revenue.

Participation in this program requires ongoing compliance with FolioProjects platform rules and activity verification mechanisms. Revenue share amounts, payout thresholds, and eligibility may be adjusted at any time at our sole discretion.

Attempts to manipulate scan data, generate fake traffic, or abuse the system will result in immediate disqualification and potential account termination.

6. Payments and Fees

Some services on the Platform may require payment. All fees are listed in Canadian Dollars (CAD) unless stated otherwise. You are responsible for any applicable taxes. Subscription or pay-per-use fees are non-refundable unless otherwise specified.

7. Termination

We may suspend or terminate your account at any time for violating these Terms. You may also request account deletion by contacting support.

Termination does not relieve either party from outstanding obligations or rights accrued before termination.

8. Platform Changes

We may modify or discontinue any aspect of the Platform at any time without notice. Where possible, we will notify users of significant updates.

9. Disclaimers

The Platform is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access, error-free performance, or outcomes from using the Platform.

We are not responsible for user content, linked third-party content, or any decisions made based on content or analytics presented on the Platform.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Platform.

11. Governing Law

These Terms are governed by the laws of British Columbia, Canada. Disputes will be resolved in the jurisdiction of Victoria, BC, following a good-faith attempt at mediation.
